Means of payment

Non-delivery

Unless otherwise specified, each delivery attempt after the second one shall be at the User’s expense.

The Holder undertakes to open a claim and/or signature disallowance file against the courier in the following cases:

  1. Loss of the package by the courier;
  2. Non-recognition by the recipient of the package of his signature on the proof of delivery.

The Holder undertakes, by interfacing with the courier, to verify the veracity of the event reported.

If the Holder establishes the veracity of the event reported by the recipient of the package, the latter undertakes, on completion of the verification procedures, to return the goods, at its own expense.

The Holder shall not, however, provide reimbursement for the above-mentioned cases (Loss of the package by the carrier; Non-recognition by the recipient of the package of his signature on the proof of delivery). The Holder in this case will deliver again the order.

 COOPERATION OF THE CUSTOMER IN CASE OF DELAYS FROM THE COURIER:

In the event of any delay with the shipment of your order as a fault of the courier company, there is total commitment from Vico Food Box to assist the customer and try in every way to resolve the inconvenience caused by the courier company promptly. 
 
We kindly ask the customer to cooperate in facilitating the resolution of the shipment, when requested, such as providing additional information, confirmation of the delivery address or any other action to ensure proper delivery.
 
The customer is required to provide a local, valid and reachable telephone number so that the courier can easily contact him/her in case of need. 
 
The customer is required to contact the numbers of the courier’s local shipping offices, which we will provide when needed. 
 
Your cooperation is essential to guarantee a quality service. 
 
We inform the customer that in the event of a return due to lack of cooperation on the part of the customer, disinterest or refusal to cooperate, the responsibility for non-delivery will be on his own part and he will be responsible for the cost of returning the parcel if he so wishes.
 

Provision of services

The service purchased shall be performed or made available at the times indicated on this Web Site or in the manner communicated prior to placing the order.

Delivery at Parcel Shop:

The Holder shall not be liable for arrangements made by the courier in the event that the goods are delivered to a collection point.

Furthermore, the owner does not take responsibility for lost boxes if a parcel shop is chosen as the shipping address.

The User is obliged to collect the goods from the address specified by the courier within and no later than the terms set by the courier.

In the event of failure to collect and consequent return of the goods to the Holder, the Goods shall not be reversed from the order and the relevant amount shall not be credited back to the Customer. The Holder shall contact the User to schedule a second delivery attempt or agree on further arrangements. In this case, any extra shipping costs shall be borne by the User unless otherwise specified.

Who enjoys the right of withdrawal

Pursuant to Article 59(1)(d) and (e) of Legislative Decree No. 206 of 6 September 2005 (Consumer Code https://www.brocardi.it/codice-del-consumo/parte-iii/titolo-iii/capo-i/sezione-ii/art59.html), the right of withdrawal is excluded in relation to:

– Goods that are liable to deteriorate or expire rapidly

– Sealed goods that are not suitable to be returned for hygienic or health protection reasons and that have been opened after delivery

– Goods purchased by a non-consumer customer purchasing with a VAT number.

– The supply of goods or services whose price is linked to fluctuations in the financial market which the trader cannot control and which may occur during the withdrawal period;

– No refund with withdrawal of the order due to late delivery by the carrier

With reference to the cases of exclusion of the right of withdrawal listed above, the Customer, in particular, is informed and accepts that the Products that are “liable to deteriorate or expire rapidly” include all food products, as the characteristics and qualities of these types of Products are subject to alteration also as a consequence of inappropriate storage. Therefore, for reasons of hygiene and protection of Users, the right of withdrawal is only applicable to Products purchased on the Website that can be returned intact in their respective seal, and put back on the market without any danger to consumers’ health.

Exercise of the right of withdrawal

The Customer shall be entitled to exercise the right of withdrawal, pursuant to Article 52 et seq. of Legislative Decree 206/2005, in relation to specific Products, other than those listed in the preceding paragraph, and in cases other than those listed in the preceding paragraph, provided that these, after delivery, have not been opened or their seals altered.

  1. In cases where the right of withdrawal is permitted, the Customer is entitled to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without any penalty.
  2. To exercise the right of withdrawal, the Customer must send, within the term of 14 days from the date of delivery of the Products, a written communication by e-mail to the following e-mail address servizioclienti@vicofoodbox.com with the subject “Exercise of the right of withdrawal order n”, providing the following information:
  1. Order number and date of purchase
  2. Date of delivery of the order
  3. Name und Anschrift des Kunden; the indication of an e-mail and telephone number of the Customer;
  4. Code of the article or articles for which it is intended to exercise the right of withdrawal.

The right of withdrawal applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, the right of withdrawal may not be exercised only on part of the Product purchased.

Upon receipt of the notice of exercise of the right of withdrawal, the return costs shall be borne by the customer. In order to receive the agreed refund, the goods must be delivered to the Holder within 14 days from the date of the request for withdrawal at the following address:

The return shall be borne entirely by the User.

In the event that the right of withdrawal is exercised, the Holder shall refund the User the full amount of the returned Products, within 14 days from the date of receipt of the notice of withdrawal, without prejudice to the right of the Holder to suspend payment of the refund until the actual receipt of the Products. The refund will be made using the same payment method used by the User.

Effects of withdrawal

The Holder shall refund all payments received including, if any, those relating to delivery costs to Users who have correctly exercised their right of withdrawal.

However, the additional cost resulting from the choice of a particular delivery method other than the cheapest standard delivery offered by the Holder shall be borne by the User.

The refund shall be made without undue delay and in any event within 14 days from the day on which the Holder was informed of the User’s decision to withdraw from the contract. Unless otherwise agreed with the User, the refund is made using the same means of payment as was used for the initial transaction. The User shall not incur any costs as a consequence of the withdrawal on contracts for the purchase of tangible goods

Unless the Holder has offered to collect the goods, the User is obliged to return them to the Holder or to another person authorised by the Holder to receive them without undue delay and in any event within 14 days from the day on which he communicated his intention to withdraw from the contract.

The deadline is met if the delivery of the goods to the carrier or other authorised person takes place before the expiry of the 14-day period described above. The refund may be withheld until receipt of the goods or until the User has provided proof of return.

The User shall be liable for any decrease in the value of the goods resulting from use of the goods other than what is necessary to establish their nature, characteristics and functioning

Return shipping costs shall be borne by the User.

Legal Warranty of Product Conformity

Legal guarantee of product conformity

The Owner is liable for any defect in the products offered on the site, including the non-conformity of the items to the products ordered, in accordance with the provisions of Italian law.

The characteristics that sanction the presence of defects and non-conformity of the ordered goods are:

– Damage occurred during the transportation of the same. Inconsistencies between the good purchased and good received in relation to the characteristics of the good and not based on its packaging (see section “Product Description”). Although the Goods on this Web Site are presented as accurately as technically possible, the representation on this Web Site by any means (including, as applicable, graphic materials, images, colors, sounds) is for reference only and does not imply any warranty as to the characteristics of the Goods purchased. In case of acceptance of replacement, no compensation will be made.

– Goods received with an expiration date prior to the date of receipt and/or with impending expiration (For more information, see section “Product Expiration”)

In case of conformity defects, the Customer must contact the Holder within 7 days of receiving the goods at the e-mail address servizioclienti@vicofoodbox.com or through the “Contact Us” section of the Website and specifying the defects found and documenting them with photographic material.

It should be noted that in the absence of photographic evidence, the User may not make any claim.

The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. In case of non-compliance, the Customer who has entered into the contract as a consumer shall be entitled, alternatively, to:

– refund or appropriate price reduction with respect to the products found to be nonconforming;

– replacement of the product found to be nonconforming at the Company’s expense, unless such remedy is excessively burdensome compared to the value of the nonconforming product;

– termination of the contract in the event of a serious lack of conformity, to be considered in relation to the total value of the expenditure made.

Expiration of the product

The Holder agrees to guarantee a minimum maturity for each category of goods, at the time of delivery of the goods. The guaranteed minimum expiration dates are:

– 5 days for very fresh products such as: fresh cheeses, fruits and vegetables.

– 15 days for fresh products such as: fresh pasta, sliced meats and cold cuts.

– 3 months for daily consumption products such as cookies and sweet and savory snacks

– 1 year for canned and boxed goods such as: canned sauces, oil, pasta and soft drinks

Upon receipt of the order, the Customer is required to check the expiration date of all goods received and report any non-conformities – to be understood only in the case of products that have already expired or are close to expiration -, within 7 days from the delivery of the same and forwarding a photographic feedback of all products concerned in which it is possible to clearly see the expiration date indicated on the packaging.

In the event that one or more goods are found to be out of date, the Customer shall be entitled alternatively, to:

– refund or appropriate price reduction with respect to the products found to be nonconforming;

– replacement of the product found to be nonconforming at the Company’s expense, unless such remedy is excessively burdensome in relation to the value of the nonconforming product;

– termination of the contract in the event of a serious lack of conformity, to be considered in relation to the total value of the expenditure made

The Holder has the full right to reject any claim inherent in non-expired goods that are based on subjective and unprovable perceptions. In the event that the Customer believes that a non-expired product, is qualitatively not up to the Customer’s expectations or not to the Customer’s liking due to personal taste, the Customer shall not be entitled to make any claim for refund, replacement or other claims by way of compensation.

No implicit waiver

The Holder’s failure to exercise any statutory rights or claims arising under these Terms shall not constitute a waiver thereof. No waiver shall be deemed final with respect to any specific right or any other claim.

Service Interruption

In order to guarantee the best possible level of service, the Owner reserves the right to interrupt the Service for the purposes of maintenance, system updates or any other change, giving appropriate notice to Users.

Within the limits of the law, the Data Controller reserves the right to suspend or terminate the Service completely. In the event of termination of the Service, the Owner shall ensure that Users can retrieve their Personal Data and information in accordance with the provisions of the law.

Furthermore, the Service may not be available due to causes beyond the Owner’s reasonable control, such as force majeure (e.g. strikes, infrastructural malfunctions, blackouts, etc.).

Resale Service

Users are not authorised to reproduce, duplicate, copy, sell, resell or exploit this Web Site or the Service in whole or in part without the prior written consent of the Owner, expressed either directly or through a legitimate reseller programme.

The Owner reserves the right to amend the Terms at any time. In this case, the Owner shall give appropriate notice of the changes to the Users.

The changes will only affect the relationship with the User in the future.

Your continued use of the Service constitutes your acceptance of the updated Terms. If You do not wish to accept the changes, You must cease using the Service. Failure to accept the updated Terms may result in either party’s right to terminate the Agreement.

The previous applicable version continues to govern the relationship until acceptance by the User. This version can be requested from the Holder.

If required by applicable law, the Controller shall specify the date by which the changes to the Terms shall take effect.

Assignment of contract

The Holder reserves the right to transfer, assign, dispose of, novate or contract out individual or all rights and obligations under these Terms, having regard to the legitimate interests of the Users.

The provisions relating to the amendment of these Terms shall apply.

The User is not authorised to assign or transfer its rights and obligations under the Terms without the written consent of the Holder.

Applicable law

The Terms are governed by the law of the place where the Holder is established, as set out in the relevant section of this document regardless of conflict of law rules.

Exception for European Consumers

However, notwithstanding the foregoing, if the User acts as a European Consumer and has his habitual residence in a country whose law provides for a higher level of consumer protection, that higher level of protection shall prevail.

Place of jurisdiction

Exclusive jurisdiction to hear any dispute arising out of or in connection with the Terms shall lie with the courts of the place where the Holder is established, as set out in the relevant section of this document. Exception for European Consumers

The foregoing does not apply to Users acting as European Consumers or Consumers located in Switzerland, Norway or Iceland.

Amicable settlement of disputes

Users may report any disputes to the Controller, who will endeavour to resolve them amicably.

Without prejudice to Users’ right to take legal action, in the event of a dispute concerning the use of this Web Site or the Service, Users are kindly requested to contact the Controller at the contact details indicated in this document.

The User may address a complaint to the Controller’s email address indicated in this document, including a brief description and, if applicable, details of the order, purchase or account concerned. The Controller shall process the request without undue delay and within 2 days of its receipt.

Controleer de tracking link, ontvangen per e-mail, om na te gaan of uw bestelling uit meerdere pakketten bestaat. Voor internationale zendingen kunnen de pakketten apart worden behandeld door de koerier. Alle andere ontbrekende producten in uw Vico Box zijn nog onderweg.

Als alle Vico Boxen in uw bestelling zijn geleverd, neem dan contact met ons op via servizioclienti@vicofoodbox.com onder vermelding van uw naam, bestelnummer en met bijvoeging van foto’s van de kleine bruine doosjes in de Vico Boxen, waarbij u vooral op de bovenstaande nummers moet letten.

Uw antwoord op de vraag “Accepteert u vervangingen van producten die niet op voorraad zijn?” zorgt ervoor dat ons magazijnteam op de hoogte is van uw wensen in het geval dat een door u besteld product niet beschikbaar is.

Bij een positief antwoord zal het magazijnteam een alternatief zoeken voor het door u bestelde product. Het vervangende product zal altijd van hogere of gelijke waarde en kwaliteit zijn als het door u bestelde product. Uiteraard wordt er nooit een toeslag gevraagd. 

Bij een negatief antwoord wordt er geen product vervangen en krijgt u het ontbrekende product terugbetaald.

De Klant kan het herroepingsrecht uitoefenen overeenkomstig Art. 52 en volgende van wetsdecreet 206/2005, op voorwaarde dat deze na levering niet zijn geopend of dat de verzegeling niet is gewijzigd.

In gevallen waarin het herroepingsrecht is toegestaan, heeft de Klant het recht om de koopovereenkomst om welke reden dan ook te ontbinden, zonder dat hij hiervoor een verklaring hoeft te geven en zonder boete.

Om het herroepingsrecht uit te oefenen, moet de Klant, binnen de termijn van 14 dagen vanaf de datum van levering van de Producten, een schriftelijke mededeling per e-mail sturen naar het volgende e-mailadres servizioclienti@vicofoodbox.com met als onderwerp “Uitoefening herroepingsrecht bestelling n”, met de volgende informatie

1-bestelnummer en datum van aankoop
2-de leveringsdatum van de bestelling
3-de naam en het adres van de Klant
4-de e-mail en het telefoonnummer van de Klant
5-de code van het artikel of de artikelen waarvoor het herroepingsrecht wordt uitgeoefend.

Om de overeengekomen terugbetaling te ontvangen, moeten de goederen binnen 14 dagen na de datum van het verzoek tot herroeping aan de houder worden geleverd op het volgende adres:
