1. Scope of application
The right of withdrawal governed by this article applies exclusively to the Consumer, meaning the natural person purchasing products for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity carried out, pursuant to Articles 52 to 59 of the Consumer Code (Italian Legislative Decree No. 206 of 6 September 2005). It does not apply to purchases made with a VAT number or for professional purposes.
2. Withdrawal period
For products eligible for withdrawal (see section 5), the Consumer may withdraw from the contract within 14 days, without any penalty and without any obligation to provide a reason.
The period starts from the day on which the Consumer, or a third party designated by the Consumer other than the carrier, acquires physical possession of the goods, and in particular:
• in the case of a single delivery, from the day of receipt of the order;
• in the case of goods belonging to a single order but delivered separately, from the day of receipt of the last item;
• in the case of regular deliveries (subscription), from the day of receipt of the first delivery.
3. How to exercise the right of withdrawal
The Consumer may exercise the right of withdrawal, before the expiry of the deadline, in one of the following ways:
• Online withdrawal function: by using the dedicated “Right of Withdrawal” function available at https://vicofoodbox.com/en/module/tecwithdrawal/withdrawal?action=list After completing the form, the Consumer confirms the request via the “Confirm withdrawal” function. Following confirmation, Vico Food Box (Cegua srl) will promptly send an acknowledgment of receipt of the withdrawal on a durable medium (e.g. by email), including its content as well as the date and time of submission;
• standard withdrawal form attached to these Terms and Conditions, or any other explicit statement of the decision to withdraw, to be sent to Vico Food Box (Cegua srl), Via Sepano, 10, 80027, Frattamaggiore, Napoli, email: info@vicofoodbox.com.
The withdrawal is considered timely if the declaration is sent before the expiry of the 14-day period.
4. Free composition of the box and partial withdrawal
The boxes sold on vicofoodbox.com are freely composed by the Consumer through the selection of individual products from the catalogue. Each product retains its own nature for the purposes of the right of withdrawal: therefore, the right of withdrawal applies only to products that are eligible (section 5) and not to excluded products.
The Consumer may therefore withdraw only in relation to the eligible products contained in their order, returning exclusively such products and receiving a refund only for the corresponding amount, as shown in the order details.
5. Products excluded from the right of withdrawal
Pursuant to Article 59 of the Consumer Code, the right of withdrawal does not apply to the following products, expressly indicated as such in the relevant product sheet prior to order completion:
• perishable or rapidly expiring products — goods that are liable to deteriorate or expire quickly (Art. 59, paragraph 1, letter d). For such products, withdrawal is excluded regardless of whether the packaging has been opened;
• sealed products for hygiene or health protection reasons — goods that, due to their nature, are not suitable for return for hygiene or health protection reasons, where the seal has been removed after delivery (Art. 59, paragraph 1, letter e).
For all other non-perishable products without hygienic seals, the right of withdrawal applies even if the outer packaging has been opened, without prejudice to the provisions of section 6 regarding reduction in value.
6. Return of products and consumer liability
The Consumer shall return the eligible products to Vico Food Box (Cegua srl), Via Sepano, 10, 80027, Frattamaggiore, Napoli, without undue delay and in any case within 14 days from the date on which the withdrawal was communicated. The deadline is met if the products are shipped back before the 14-day period expires.
The direct costs of returning the products shall be borne by the Consumer.
The Consumer is only liable for any reduction in the value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, and functioning.
7. Refund
Vico Food Box (Cegua srl) will reimburse all payments received in relation to the products subject to withdrawal, without undue delay and in any case within 14 days from the date it was informed of the decision to withdraw. The refund will be made using the same payment method used for the purchase, unless otherwise agreed, and at no cost to the Consumer.
In the case of partial withdrawal relating to a box composed of multiple products, the refund will correspond only to the value of the eligible products actually returned, as shown in the order details.
Vico Food Box (Cegua srl) may withhold the refund until it has received the goods or until the Consumer has provided proof of return, whichever occurs first.
From the refund amount, Vico Food Box (Cegua srl) may deduct any amount corresponding to a possible reduction in value of the returned products, where such reduction results from handling other than what is necessary to establish their nature, characteristics, and functioning, pursuant to Article 57 of the Consumer Code. In any case, the refund is not conditional upon the resaleability of the returned products.
8. Failure to provide information
If Vico Food Box (Cegua srl) has not provided information on the right of withdrawal, the withdrawal period shall be extended in accordance with Article 53 of the Consumer Code.
